1. Description of Service

TinyRoots Pro ("we", "our", or "us") provides a specialized software-as-a-service (SaaS) platform engineered for California Family Child Care Homes (FCCH) and licensed early care facilities. Our service provides attendance tracking, caregiver-to-child ratio calculations under California Title 22, incident and safety logging, emergency pickup verification, child profiles, and tuition billing computations.

2. Account Registration & Security

To use TinyRoots Pro, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration and keep your account profile updated.
• Maintain the confidentiality and security of your login credentials (username and password). You are fully responsible for all activities that occur under your account.
• Notify us immediately at [email protected] if you discover or suspect any unauthorized access to your account or any security breach.
• Ensure that only authorized facility personnel and verified legal guardians are invited or granted access to your facility's tenant account.

3. Regulatory Compliance & Customer Responsibility

TinyRoots Pro provides automated tools designed to assist California childcare operators with record-keeping and licensing standards:

• Operator Licensing Responsibility: The licensed facility operator remains solely and legally responsible for ensuring that their facility complies with all applicable California Community Care Licensing Division (CCLD) regulations, California Code of Regulations (CCR) Title 22, and California Health and Safety Code § 1597.465.
• Operational Aid: TinyRoots Pro is an administrative operational tool and does not constitute legal, medical, or regulatory advice. While our automated ratio rule engine and capacity calculators are designed to reflect Title 22 guidelines, operators must independently verify staffing and child counts during daily operations.
• Mandated Records Retention: Facility operators are responsible for preserving required records (such as 3-year attendance logs under CCR § 102419 and incident logs under CCR § 102424) and can export their data at any time through the administration command center.

4. Customer Data Ownership & Privacy

• Ownership of Customer Data: As between you and TinyRoots Pro, you retain all ownership, title, and intellectual property rights in and to the data you upload or enter into the platform (including child profiles, attendance records, guardian contacts, notes, and photos).
• License to Provide Services: You grant TinyRoots Pro a worldwide, limited, non-exclusive license to host, process, transmit, and display Customer Data solely to the extent necessary to provide, maintain, and support the services.
• Privacy Policy: Our collection, processing, and protection of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. We do not sell personal data, do not use customer data for advertising, and enforce strict database multi-tenant isolation.

5. Acceptable Use Policy

You agree not to misuse TinyRoots Pro. Specifically, you agree that you will not:

• Use the service for any illegal purpose or in violation of any local, state, national, or international law.
• Attempt to probe, scan, or test the vulnerability of the system or network, or breach any security or authentication measures.
• Attempt to access data or accounts belonging to any other facility tenant or user without authorization.
• Reverse engineer, decompile, disassemble, or derive the source code of the software or client applications.
• Upload or transmit any viruses, malware, or destructive code.

6. Subscription, Fees & Cancellation

• Subscription Fees: Facility accounts are billed according to the subscription tier or plan selected upon signup. Fees are charged in advance on a recurring monthly or annual basis.
• Free Trial: We may offer trial periods (such as a 3-month free trial). Unless cancelled prior to the trial expiration, subscription fees will apply at the conclusion of the trial period.
• Cancellation: You may cancel your subscription at any time through the customer portal or by contacting support. Upon cancellation, your account will remain active through the end of the paid billing cycle, and you will have the ability to export all facility records.

7. Offline Operation & Service Availability

TinyRoots Pro includes local queue persistence and offline-first capabilities to support uninterrupted attendance check-in/out during local network outages. However:

• The services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for high uptime and rapid synchronization, we do not warrant that service will be completely uninterrupted or error-free.
• Users are responsible for ensuring their mobile and kiosk devices periodically connect to the internet to reconcile offline event queues with cloud servers.

8. Limitation of Liability

To the maximum extent permitted by applicable California and federal law, TinyRoots Pro and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or business interruption) arising out of or related to your use of or inability to use the service. Our total aggregate liability for any claims relating to the service shall not exceed the total fees paid by you to TinyRoots Pro in the twelve (12) months preceding the claim.

9. Governing Law & Jurisdiction

These Terms of Service and any dispute arising out of or related to them will be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in the State of California.
